"The warranty expired" answers a different question from the one you are asking. A manufacturer’s written warranty is an additional promise layered on top of your rights, not a replacement for them. When it ends, the implied warranty of merchantability does not automatically end with it — that runs on your state’s statute of limitations for contract claims, typically several years from delivery rather than from when the fault appeared.

Where a written warranty was given, the Magnuson-Moss Warranty Act does two useful things. It prevents the implied warranties being disclaimed for the duration of that written warranty, and it lets a consumer who prevails recover attorney fees — which is what makes an otherwise modest claim economically worth a lawyer’s time.

Expect a repair to be offered before a refund, because in the US the seller is generally entitled to attempt one. What they are not entitled to is unlimited attempts. Once a reasonable number have failed and the fault persists, the remedy has failed its essential purpose and a refund or replacement comes back onto the table. Keep a dated log of every attempt, because the count is the whole argument.

Can a store sell something "as is" to avoid this?

Sometimes, but not easily. The disclaimer generally has to be conspicuous and made at the time of sale, it cannot be used where a written warranty was given, and a minority of states prohibit disclaiming implied warranties in consumer sales entirely.
